Yesterday, Democracy Now reported that there is a steady rise in hate crimes against Latinos. There has been a 40 percent rise since 2003. In 2007, NPR interviewed Mark Potok from the Southern Poverty Law Center. Hate crimes are defined by violence motivated by the offenders bias against the perosn’s race, religion, sexual orientation or national origin. The Southern Poverty Law Center reports that this violence could be due to the national immigration debate.  Here is a quote from their blog:

At the same time as anti-Latino violence has risen, the Southern Poverty Law Center has reported a major increase in hate groups — from 602 in 2000 to 888 in 2007, a 48% percent jump — and said that the growth has been almost entirely driven by the immigration debate. White supremacist groups that normally target African Americans and Jews have focused heavily for the last several years on the “threat” of Latino immigrants, exploiting the issue successfully in order to recruit more and more members, especially in the border states. That has only begun to change recently, as hate groups increasingly turn their attention to the subprime crisis (which they blame on minorities) and the likely prospect of a black president.

This is an issue we Latinos need to watch and report when it happens.  Even if you do not have papers that does not mean that US citizens have the right to hurt you or your property.

What a roller coaster this man has to travel. This is the third time he has been able to postpone his execution. Troy Davis now has 25 days to seek habeas corpus.

“I am extremely relieved that the 11th Circuit, when addressed with such a grave issue as the innocence of a man set for execution, wants to hear argument and make a considered judgment,” said Tom Dunn, a member of Davis’ legal team.

The state Attorney General’s Office canceled Monday’s execution, spokesman Russ Willard said, adding that state attorneys are exploring the their options.

On Wednesday, Davis asked the 11th Circuit for permission to pursue a new federal habeas corpus petition — in which an inmate claims he is unlawfully incarcerated. The Antiterrorism and Effective Death Penalty Act of 1996 requires a federal appeals court to approve such a request before such a new lawsuit can be filed.

“Upon our thorough review of the record, we conclude that Davis has met the burden for a stay of execution,” the court said in an order issued by Judges Joel Dubina, Rosemary Barkett and Stanley Marcus.

The judges called the stay “conditional” and said they want to hear more from Davis’ lawyers and state attorneys.

Davis must clear two difficult legal hurdles to win a new round of appeals.

First, he must show that his lawyers could not have previously found the new evidence supporting his innocence no matter how diligently they looked for it. And he must show that the new testimony, viewed in light of all the evidence, is enough to prove “by clear and convincing evidence that…no reasonable fact finder would have found [him] guilty.”

The 11th Circuit added a twist. It asked the parties to address whether Davis can still be executed if he can establish innocence under the second standard but cannot satisfy his burden under the first, due-diligence question.

The court gave Davis’ lawyers 15 days to file their legal brief and state attorneys another 10 days to respond

Troy Anthony Davis has been denied justice. He was accused of murdering a policeman, however seven of the nine witnesses have changed their story.

Please fax Governor Sonny Perdue and say the people do not want Troy Davis executed please commute the sentence, this is destroying the confidence of the people in the state lawmakers present and future and where are concerned about executing someone who has a strong case of innocence even thought the courts have refused to hear new evidence contrary to what the prosecutor is saying and that we will not support a state government killing in our name any longer.
According to the Georgia Constitution Article V Section II, it says the governor does have chief executive powers, that the governor is the conservator of peace throughout the state, so constitutionally there is nothing preventing the governor to step in when public opinion says STOP the EXECUTION of TROY DAVIS. This will not be seen as usurpation of the Parole Board’s constitutional power, they are appointed by the governor.

Opps! Too  bad he gets to sit  pretty on some big money while the regular person has to suffer through this tough economic period.  In my neighborhood there are a now two abandoned homes within 50 yards of our home.  Maybe we can start squatting and take back the lost homes.

November 1st is World Vegan Day, and to Lush, that sounds like a challenge! Here at Tyson’s Lush, we’re challenging our staff and customers to go vegan for a day. To reward you for trying out our challenge, we’re going to pamper you with vegan products as well as delicious vegan goodies! Come prepared for trivia, snacks, and, of course, wonderful vegan-style pampering. Spend $50 and receive an all-vegan goodie bag!

This year I am planning to go to the SOAW Vigil in Nov.  21-23.

This is a school that has trained soldiers and military leaders that have committed some of the worst human rights abuses in Latin America.  On Nov. 16, 1989 six Jesuit priests, Elba Ramos (community cook) and her 14 year-old daughter Celina Ramos were murdered by soldiers trained in the SOA.  You can read an article written by the president of Georgetown reporting on this incident here.  My family is from El Salvador.  I would like to join in solidarity with the poor and oppressed of my family’s country.   For this reason I feel like this training center should be shut down.  I have friends and family that have suffered from these soldiers trained at SOA.  I encourage you to join this movement.

In 2001, the Pentagon changed the SOA name to The Western Hemisphere Institute for Security  Cooperation (WHISC).  The goal of SOAW is to change the oppressive foreign policy in Latin America.  Join us in Nov. at Fort Benning if you are interested in supporting SOAW.
